I haven't read the whole thing in a while, but quote from this disquisition on the rule of law rather regularly. Although the Justice makes the point that the obligations that fall on agents of government are not well understood around the globe, there's a goodly number of U.S. government officials who don't seem to appreciate that the Constitution and the rule of law is addressed to and applies to them.
Which also accounts, on the other hand, why efforts to legislate the behavior of individual citizens and even so-called "private" corporations fall flat. Governmental agencies are supposed to "do," not "tell" the citizenry what to do.
Anyway, given some of the momentous cases coming before the Court and the likelihood that Kennedy will again be a swing vote, I'm going to reproduce his address, interlaced with some commentary I can't resist.
